The representation of the Petitioner is regarding the period where the Petitioner has not joined on the transferred post. The observation of the order in Appeal passed by the Commissioner, Pune rejecting the Appeal arising from the mutual transfer, are that the period of two years, where the Petitioner did not join, the Petitioner himself is responsible for the loss. This would indicate that the Commissioner has opined on how the period needs to be treated.

The Petitioner should have taken substantive proceedings in light of this observation, subject to delay and laches. 3.
