Being aggrieved by the judgment and order dated 28.06.2023 passed by the learned Presiding Officer, School Tribunal, Latur in M.A. No.33 of 2022, the school management has filed this writ petition. Vide the impugned order, the learned Presiding Officer has condoned the delay caused in filing the appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and Rules 1981.

Mr. V. P. Golewar, learned counsel submits that in the meantime, the appeal itself is dismissed by the learned Presiding Officer on merits. He submits that Writ Petition No.11062 of 2024 filed by the employee/appellant in the Tribunal which is still pending adjudication. In view of this, nothing survives in this writ petition.

Writ Petition No.5424 of 2024 is disposed of. 4.

It is clarified that the petitioner has liberty to take all available ground to defend Writ Petition No.11062 of 2024. 5.
