By this petition, the challenge is to the order passed by the Respondent No.1 reversing the order of District Superintendent of Land Records based on the Will produced by the Respondent No.3, which according to the petitioner was not produced before the District Deputy Director of Land Records while mutating the name of Respondent No. 3, Shri. Yashwant Krushnarao Shirolkar with the Application at page 54.

Mr. Patil submits that the Respondent No.3 has made a false declaration of being the only legal heir whereas there are 9 legal heirs. He would further point out Exhibit E which is the checklist at page 57 in which the Respondent No.3 had given a declaration that there is no Sairaj 1 of

8 Wp-5596-2024.doc Will executed by the deceased. He submits that, for the first time before the Hon'ble Minister, the Will has been produced and based on the same, the impugned order has been passed. 4.

Issue Notice to the Respondent returnable on 11th December, 2024.

Learned AGP waives notice for the Respondent Nos. 1 and 2. 6.

In the meantime, there should be no change in the mutation entries in respect of subject property.
