The challenge in the Petition is to order dated 4 March 2023 passed by the Trial Court allowing Application at Exhibit-5 and granting temporary injunction. Apart from the fact that the Petitioners have remedy of filing Appeal against order dated 4 March 2023 under the provisions of Order 43, Rule 1 of the Code of Civil Procedure, 1908 (the Code), nothing survives to be adjudicated in the Petition since the Suit itself has been disposed of by separate order passed today in Civil Revision Application No.128 of 2021.
