The challenge in the present petition arises out of proceedings under Section 23(2) of the Maharashtra Cooperative Societies Act, 1960 ("the MCS Act"), against which the petitioner has an alternative statutory remedy by way of revision under Section 154 of the MCS Act.

Accordingly, keeping all questions raised in the present petition open to be agitated in the revision application, the present petition stands disposed of.

The time spent in prosecuting the present petition shall be excluded while computing the period of limitation for filing the revision application.

On filing of such revision application, the Revisional Authority shall decide the same within a period of three months from the date of filing of the revision application. (AMIT BORKAR, J.)
