Prima faice, the reasons for dismissal of the complaint is in absence of approval by the Government to this Staffing Pattern submitted by the Society. Prima facie, the respondent is the Cooperative Society paying salary of such employees from their own funds.

Prima facie, there is no requirement of approval of the Staffing Pattern either under the provisions of the Maharashtra Cooperative Societies Act, 1960, the Maharashtra Cooperative Societies Rules, 1961 and Bye Laws of Cooperative Societies. 4.
This Court in a proceeding arising out of interim order, protected the petitioners services. It is not in disputed that the petitioners are working as of now; hence, during pendency of the petitions, there shall be interim relief in terms of prayer clauses (b) & (c).
