...Petitioner

versus The State of Maharashtra & Ors.

...Respondents

---- Mr.Prashant Bhavake for the Petitioner.

Ms.P.N.Diwan, AGP for the Respondent -State.

---- CORAM :

RAVINDRA V. GHUGE & ASHWIN D. BHOBE, JJ.

DATE : 6TH MARCH, 2025 P.C. :- 1.

This Petition was filed by the Petitioner Employee under the impression that the proposal seeking approval to his appointment as a Shikshan Sevak, dated 14th April, 2023, is still pending with the Education Officer.

2.

The learned AGP submits, on instructions, that as the Education Officer noticed certain deficiencies in the proposal, he communicated those deficiencies to the Management vide letter dated 24th July, 2023, photostat copy of which is tendered across the bar and marked as 'X' for identification.

3.

The learned Advocate for the Petitioner submits that the Management will have to remove the deficiencies and submit the revised proposal.

4.

Considering the above, we find no reason to keep this Petition pending and the same is disposed off without issuing notices.

5.

The Management shall remove the deficiencies and submit the revised proposal, on or before 15th April, 2025. Thereafter, the Education Officer would carry out a meticulous verification exercise and pass a reasoned order on the said proposal, on or before 10th June, 2025.

6.

The Petitioner would communicate this order to the Management expeditiously.

7.

If the proposal is rejected with reasons, the aggrieved party would be at liberty to avail of a remedy as may be permissible in law. If the proposal is granted, appropriate steps for grant of the Shalarth ID shall be initiated.

8.

We make it clear that we have not expressed any opinion as regards the merits of the proposal. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.)
