The present petition under Article 226 of the Constitution questions the order passed by the Divisional Joint Registrar. In that order, the Registrar decided the objections raised by the respondents concerning the elections of the society. The Registrar also issued directions to the Deputy Registrar to hold an inquiry into the issues of property tax, maintenance charges demanded by the respondent society, and other matters set out in the petitioner's complaint.

The record shows that a Division Bench of this Court, in Writ Petition No. 2324 of 2015, by order dated 4 January 2019, directed the Deputy Registrar to decide the representation at Exhibit J. In compliance with the earlier directions of this Court in Writ Petition No. 3322 of 2018 dated 6 October 2018, the Deputy Registrar decided the representation by order dated 3 November
903-wp-7138-2024.doc 2018. The petitioner challenged that order by filing Revision Application No. 548 of 2018. The Revisional Authority disposed of the revision and directed the Deputy Registrar to conduct a proper inquiry on the issues of property tax, maintenance charges raised by the society, and the other grievances mentioned in the complaint.

Fresh elections have already taken place. The objections relating to the earlier elections have, therefore, lost their significance. The only surviving issues concern the demands of property tax, maintenance charges, and other grievances raised by the petitioner. It is appropriate that the Deputy Registrar, Cooperative Societies, D Ward, Mumbai, be directed to decide the petitioner's representations dated 11 September 2017, 10 July 2018, and 10 September 2018. The Deputy Registrar shall decide them on their own merits, according to law, and only in respect of matters unconnected with the elections of the society. 4.
In view of these directions, the writ petition is disposed of. 5.
No order as to costs.
