We have perused the order dated 21st December, 2022 passed by this Court (Coram : Nitin W. Sambre & Sharmila U. Deshmukh, JJ.) in Writ Petition No.890 of 2020, with a clear direction in paragraph nos.3 and 4, as under :

In this background, submissions are made by Mr. Bhavke, on instructions from the petitioner who is present in the Court that the petitioner shall be moving before the Education Officer i.e. the respondent no. 5 within a period of four weeks from today through representation with a prayer for repatriation of his services to the respondent no.7-school.

4. We direct the respondent-Education Officer to decide the said representation of the petitioner expeditiously and in any case by 30/04/2023.

The Petitioner tendered such representation on 13th January, 2023, within 20 days of the order of this court. Yet, the Gauri Gaekwad

905.WP-7433-2024.odt said Application is said to be pending at the doorstep of Mr. Eknath Ambokar. The learned AGP points out a recital of the meeting dated 11th April, 2023, which is reduced into writing by Dr. Eknath Ambokar on 17th April, 2023 wherein it is stated that the Management should absorb the Petitioner on a vacant post available with the Management. He points out one more communication dated 23rd June, 2023 calling upon the Management to submit a proper proposal so that he can decide it and he gave a timeline of eight days to the Management. Further reminder is also sent on 11th August, 2023. Yet the Management has not complied with the directions. 3.

Issue notice to the Respondents, returnable on 26th March, 2025. The learned AGP waives service of notice on behalf of Respondent Nos.1 to 5.

The Management shall file an affidavit in reply as to why the proposal of the Petitioner is not being forwarded. Let the affidavit in reply be filed, at least, ten days prior to the returnable date.
