In the instant writ petition, the petitioner, inter alia, seeks to quash and set aside the impugned order of 19th May, 2022 and order dated 19th May, 2023 by which the representation submitted by the petitioner was rejected. 2.

The petitioner had offered a highest bid in respect of Plot No. 100, Sector 11 at Kharghar. The bid of the petitioner was rejected on the ground that the rate quoted by the petitioner is less than the market value. The petitioner submitted a representation. The said representation was rejected by an order dated 19th May, 2023.

In the aforesaid factual background, this petition has been filed.

Learned counsel for the petitioner submits that fresh auction is scheduled to be held on 27th July, 2025 and, therefore, he seeks leave of this Court to withdraw the writ petition with the liberty to submit a fresh representation to CIDCO for retention of allotment of plot in favour of petitioner if the fresh auction process does not fructify into allotment of plot to any bidder.

In view of the aforesaid submission, writ petition is dismissed as withdrawn in terms of the liberty as prayed for. (SANDEEP V. MARNE, J.) (CHIEF JUSTICE)
