The challenge in the present Petition is to the interim order dated 20 February 2023 passed by the learned Member, Industrial Court, Pune, allowing Application (Exhibit U-2) and directing the Petitioners to allow the Respondents to resume duty during pendency of the Complaint. The interim order was passed on 20 February 2023 and by now period of about two long years has lapsed and the said order has actually not been implemented.

Mr. Rao, the learned counsel appearing for Respondent would fairly submit that instead of determining the correctness of the order dated 20 February 2023 at this stage, it would be appropriate that the Industrial Court is requested to decide the Complaint finally in an expeditious manner.

Writ Petition is accordingly disposed of by requesting the Industrial Court to decide Complaint (ULP) No.1 of 2022 as expeditiously as possible preferably within a period of one year. 4.

Since the Complaint itself is being finally heard, order dated 20 February 2023 is set aside, without considering merits of the matter.

With the above directions, the Writ Petition is accordingly disposed of.
