CIVIL APPELLATE JURISDICTION HEMANT CHANDERSEN SHIV Date: 2026.03.16 10:36:10 +0300 WRIT PETITION NO.9786 OF 2024 Deepak Narayan Shigvan
...Petitioner
Versus
Recovery Officer & Ors.
...Respondents
Mr Pankaj Das for the Petitioner.
Mr Prashant Sarwankar for Respondent Nos.1 and 2.
CORAM:
SUMAN SHYAM & SHYAM C. CHANDAK, JJ.
DATED:
11th MARCH, 2026 PC:- 1.
Heard Mr.Das, learned Counsel for the Petitioner and Mr.Sarwankar, learned Counsel for Respondent Nos.1 and 2. 2.
Learned Counsel for the Respondents submit that during the pendency of this Writ Petition, the objection filed by the Petitioner has been decided by Respondent No.1. Therefore, the Writ Petition has worked out insofar as prayer clauses (a), (b) and (c) are concerned. The said submission is not disputed by the Petitioner's Counsel. However, according to him, the Petitioner has not got the relief.
54.W9786.24.DOC 3.
Be that as it may, since it is not in dispute that the Writ Petition has worked out after a decision was taken in the objection of the Petitioner by the Respondent No.1, we do not find any justification to keep this Petition pending. The same is accordingly disposed of.
4.
The Petitioner would, however, be at liberty to avail appropriate legal remedy including filing of Writ Petition, assailing the decision of the Respondent No.1, seeking further direction in the matter, if so advised.
