Heard learned counsel for the parties.

It is the grievance of learned counsel for the Petitioner that the representation made by the Petitioner which is at page 52 of the paper-book dated 14/02/2023 is not decided. The Petitioner has prayed for a relief directing the Kalyan Dombivali Municipal Corporation ("KDMC" for short) to grant benefit of pay fixation to the Petitioner with effect from 30/07/1997 and further grant benefit of PMB

903.wp.10255-2024.doc financial upgradation under ACP Scheme on completion of 12 years of regular service from the date of appointment as granted to the other similarly situated 170 employees of the KDMC.

The Present Petition can be disposed of by directing the Respondent-Corporation to decide the representation dated 14/02/2023 which is at page 52 of the paper-book on its own merits and in accordance with law within a period of six weeks from today. Needless to mention that if the Petitioner is similarly situated as the other employees who have been granted the benefit, all things being equal, even the Petitioner will be entitled to the benefits. 4.

The Writ Petition is disposed of.
