The petitioner challenges the order dated 29th September 2022 passed by the Deputy Director of Education by which he declined to grant approval for appointment of the petitioner on the post of Shikshan Sevak under Shri Babubhai Ponda Junior College of Commerce. 3.
Mr. Vinayak R. Kumbhar, the learned counsel for the petitioner submits that summary rejection of the proposal submitted by the respondent no.4-College has caused serious prejudice to the petitioner and at-least one opportunity should have been given to the respondent no.4College to submit documentary evidence in support of the appointment of the petitioner on the post of Shikshan Sevak for which an advertisement was issued on 20th June 2014 vide Exhibit-D at page 35 of the paper-book. 4.
The petitioner has produced a copy of the No Objection Certificate and other documents to support his appointment on the post of Shikshan 1/2 13-WP-16793-2024.doc Dixit
Sevak. However, the respondent no.2 has taken a stand in the reply affidavit filed by him that entire exercise for appointment of the petitioner was highly suspicious and the Management instrumentalised the inward stamps of the Education Department in a clandestine manner. Therefore, we direct that the Chief Executive Officer, Zilla Parishad may institute an enquiry by a senior officer from the Education Department to fix the responsibility on the person who signed the applications submitted by the Management.

At this stage, leaving all contentions open, this writ petition is disposed of with a direction to the Chief Executive Officer, Zilla Parishad to conclude the enquiry in three months. If the enquiry report does not record any involvement of the petitioner or the Management in the recruitment exercise, the proposal submitted by the Management for appointment of the petitioner on the post of Shikshan Sevak shall be processed within next two months, after granting opportunity to the Management to produce any documentary evidence, if any, if necessary. 6.
