Heard the learned Advocates for the respective sides and perused the petition paper book with their assistance. 2.

This is yet one more case wherein, the Education Officer has raised queries and pointed out the deficiencies in the proposal forwarded by the Management and instead of permitting the Management to remove deficiencies, he has rejected the proposal. 3.

In view of the above, this Writ Petition is partly allowed. Nikita

18-wp-16804-2024.odt The impugned order dated 4th May, 2023 stands quashed and set aside and the proposal of the Management shall stand restored to the file of Respondent No.3.

The Management, which is before us as a Petitioner No.2, shall remove all the deficiencies and answer the queries raised by Respondent No.3 in its communication dated 4th May, 2023 which shall be treated as a notice to the Management. This exercise would be completed within a period of 45 days from today. 5.

Thereafter, Respondent No.3 would deal with the proposal on its own merits by carrying out a meticulous verification exercise and pass a reasoned order, preferably within a period of 60 days. (ASHWIN D. BHOBE, J.) (RAVINDRA V. GHUGE, J.) Nikita
