Learned counsel for the appellants submits that the Second Appeal is not maintainable and the impugned order is appealable under sub-rule 1(u) of Order XLIII of the Civil Procedure Code, 1908. She therefore seeks leave to convert the Second Appeal into Appeal from Order. Leave granted. Amendment to be carried out within four weeks.
