CORAM: SANDEEP V. MARNE, J.

DATE : 13th FEBRUARY, 2024.

P. C.:

1.

It appears that the order challenged in the present Appeal is passed by the District Judge in Misc. Civil Application No.05/2021. 2.

In Misc. Civil Application No. 05/2021, the Appellant has challenged Order dated 7th May, 2020 passed by the Trial Court on Application at Exhibit 5. Thus, what is required to be filed is Appeal from Order under the provisions of Order 43 Rule 1 of the Code of Civil Procedure, 1973. Accordingly, leave is granted to the Appellant to convert the "Second Appeal" into "Appeal from Order". 3.

Necessary amendment to be carried out within a period of two weeks from today.
