IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL REVISION APPLICATION NO.12 OF 2024 Mohammed Hanif Nalkhande & Ors.
....Applicant V/S Shaikh Abdul Khalick & Anr.
....Respondents ________ Mr. Rohan A. Waghmare for the Applicants.
Mr. Ramesh Ramamurthy, Mr. Saikumar Ramamurthy and Ms. Seema Sorte for Respondent No.1.
Mr. Rahimtulla Momin for Respondent No.2.
__________ CORAM: SANDEEP V. MARNE, J.
DATE : 25 FEBRUARY 2025.
P.C.:
Considering the fact that the impugned order passed by the Maharashtra State Waqf Tribunal merely remands the proceedings to the Waqf Board for being decided afresh after grant of opportunity of hearing to Respondent No.1, I am not inclined to entertain the Civil Revision Application filed by the Applicants. The impugned order passed by Waqf Tribunal would only ensure that relevant facts are brought to the notice of Waqf Board for decision of change report afresh. All rights and contentions of the parties are expressly kept open. The Waqf Board shall decide the remanded proceedings without being influenced, in any manner by the order dated 7 November 2023 katkam Page No.
