Heard learned Advocate for the Applicant-Plaintiff and learned Advocate for Respondent No.6. The application was filed before the trial Court under the provisions of Order 12 Rule 6 of Civil Procedure Code. Predominantly, it is filed on following grounds:- (i) the averments in the written statement filed by defendant Nos.1,5,6 and 7.

(ii) defendant Nos.2,3 and 4 have not appeared. There is an exparte order.

(iii) certain averments in the plaint were not denied in the written-statement.
