55-fca-33-2024.doc with his father undertake to withdraw the proceeding bearing Suit No.253 of 2020 pending before the City Civil Court at Greater Bombay.
3) The Respondent/wife also undertakes to withdraw the case filed by her in the Family Court at Bandra, Mumbai bearing no. E-202 of 2023.
4) Both the parties have agreed to apply for divorce by mutual consent in the Family Court at Bandra on the aforesaid terms. The Respondent-Wife has waived permanent alimony and maintenance for herself from the Appellant.
5) In view of the aforesaid settlement, the AppellantHusband seeks leave to withdraw the Appeal. Leave granted. 6) The Family Court Appeal is disposed as withdrawn. (S. N. Phad) (V. V.
