This is an application filed for withdrawal of the amount of compensation deposited in this Court.

Perused the application and heard learned advocates for both sides. Learned advocate for the respondent submitted that the earlier application, filed for withdrawal of the amount, has been turned down on the ground that the limited liability of compensation i.e. Rs.2,00,000/- is covered by the Insurance policy of the offending vehicle. Learned advocate for the applicant submitted that to the extent of Rs.2,00,000/- at this stage the said amount of compensation can be permitted to be withdrawn.

Considering this aspect, learned advocate for the

ca2784.24 -2respondent submitted that to the extent of Rs.2,00,000/- liability the application can be allowed.

In view of above, the application is allowed. The applicant is permitted to withdraw an amount of Rs.2,00,000/- alongwith interest and proportionate costs, on furnishing usual undertaking to the satisfaction of Registrar (Judicial) of this Court. (SANJAY A. DESHMUKH, J.) rlj/
