He submitted that this Court, in First Appeal No.979 of 2009 and another connected appeal decided on 14.10.2025 in the case of Executive Engineer, Latur vs.

The State of Maharashtra and Others, confirmed the judgment of the learned Land Reference Court and held that the learned Reference Court was justified in awarding compensation at the rate of Rs.1,35,000/- per acre for seasonally irrigated land. Mr. S. B. Gastgar, learned advocate for the appellantsclaimants in First Appeal Nos.1748 of 2014, 14/2011, 22/2011 and 23/2011 pointed out the findings of the learned Reference Court and submitted that the lands of these claimants are seasonally irrigated. It is submitted that in view of the judgment of this Court in First Appeal No.979 of 2009, which has attained finality, the claimants are entitled to compensation on the principle of parity at the same rate i.e., Rs.90,000/- per acre for dry land and Rs.1,35,000/- per acre for seasonally irrigated land, as awarded by the learned Reference Court

(( 27 )) in L.A.R. No.133 of 2003 and L.A.R. No.346 of 2002, which was confirmed by this Court by judgment dated 14.10.2025 in First Appeal No.979 of 2009. The learned AGP for the State and learned advocate Mr. S. G. Sangle for the acquiring authority submitted that the principle of parity cannot be applied to the cases of the appellants-claimants, as their cases are not covered by the judgment of this Court or by the judgment of the learned Reference Court in L.A.R. No.133 of 2003 dated 17.07.2008. They prayed to dismiss the appeals. 7.

Perused the Record and Proceedings, particularly the judgment relied upon by the learned advocates for the claimants. The land in the said judgment was acquired for the one and the same purpose as in the present appeals for construction of a percolation tank. The notification under Section 4 was also published on the one and same date. In those cases, the learned Reference Court awarded compensation at the rate of Rs.1,35,000/- per acre for seasonally irrigated land and Rs.90,000/- per acre for non-irrigated land, which has been finally confirmed by this Court in First Appeal No.979 of 2009 decided on 14.10.2005. Therefore, the claimants are entitled to

(( 30 )) the same rate of compensation on the principle of parity. The appeals filed by the claimants deserve to be allowed by partly setting aside the impugned judgment and award. The appeals filed by the acquiring body deserve to be dismissed, as there is no scope to interfere with the impugned judgment and award. Hence, the following order: ::ORDER::

The First Appeal Nos.1121 of 2009, 302/2009, 296/2009, 301/2009, 298/2009, 299/2009, 297/2009, 295/2009, 300/2009 and FA (ST)NO. 18615 OF 2007 are dismissed. II.

The First Appeal Nos. 1117 of 2007, 19/2011, 1653/2011, 1658/2011, 692/2016, 697/2016, 1656/2011, 1096/2007, 11/2011, 1123/2007, 1748/2014, 1742/2014, 1655/2011, 695/2016, 26/2011, 14/2011, 1744/2014 21/2011, 23/2011, 18/2011, 22/2011, 1746/2014, 1749/2014, 1743/2014 are partly allowed.

The impugned judgment and award are partly set aside and modified as under:

It is clarified that the appellants / claimants are not entitled to the interest for the period of delay, if any, condoned by this Court.

VI.

The respondent-Acquiring Authority is directed to deposit the enhanced amount of compensation along with all statutory benefits like component, interest and solatium in this Court as per the provisions of the Land Acquisition Act, 1894 within six months.

VII.

If court fee is not sufficiently paid, the appellants-claimants shall pay deficit court fee. On receiving the same, the enhanced amount of compensation be paid to the claimants.

VIII.

Award be drawn up accordingly.

IX.

Pending civil applications, if any, are disposed of. X.
