This Application has been filed for bringing on record the legal heirs of Deceased Respondent No. 2 - Popat Mahipati Borkar. The Death Certificate of said Respondent No. 2 is enclosed with the Application. The Applicants are the widow and sons of Deceased/ Respondent No. 2. The Petition is for recovery of dues which were payable to the Deceased / Respondent-Popat by the Sugar Factory.

The Application is allowed in terms of prayer clause 'B', 'C' and 'D', which reads as under:

"B.

Hon'ble High Court may be pleased to condone the delay of 342 days caused in preferring Civil Application for bringing legal heirs of deceased Popat Mahipati Borkar on record of Writ Petition.

C.

Hon'ble High Court may be pleased set aside the abetment caused if any.

D.

Hon'ble High Court may be pleased to permit to bring the legal heirs of deceased Popat Mahipati Borkar on record of this Writ Petition which are more particularly mentioned in Paragraph No. 2."
