[CORAM : NITIN B. SURYAWANSHI, & VAISHALI PATIL-JADHAV, J. J.] DATE : 23 rd MARCH, 2026 ORDER :

1.

By this Petition, filed under Article 226 of the Constitution of India, the Petitioners seek following relief: "A.

The Hon'ble High Court may be pleased to issue writ of

{2} mandamus or any other appropriate writ, order or direction of the like nature thereby directing the respondent authorities to maintain the register in Form No. VII-A and VII-B on a year to year basis, as per the provisions of Maharashtra Land Revenue Record of Rights and Register (Preparation and Maintenance Rules) 1971 and the Maharashtra Revenue Manual in respect of the present Petitioners for village Vajara Shefa and Mauje Dattamanjari, Tq- Mahur, DistNanded" 2.

By the documents annexed to the Petition, the Petitioners have demonstrated that though the State Co-ordinater and Settlement Commissioner, Pune has made it clear that Form No. VII-A and VII-B are to be maintained in terms of Rules 31 and 32 of the Maharashtra Land Revenue Record of Rights and Registers (Preparation and Maintenance) Rules, 1971 and the same are intact and in spite of issuance of Circulars dated 24th November, 1997 and 12th November, 2002, Form No. VII-A and VII-B are not supplied to the Petitioners. The Petitioners have placed on record their representations seeking copies of the registers maintaining Form No. VII-A and VII-B and notice making similar demand is also issued by the Petitioners to the Respondents on 25th November, 2019. Pursuant to the said notice, the Settlement Commissioner, by reply dated 23rd December, 2019, has reiterated that computerized seven twelve extract (in extract No. 12) is prepared under rule 29 of the 1971 Rules and, therefore, there is no question of any change in the same. So also in the Land Revenue Manual, in Column 4 Chapter

{3} 2, Form No. VII-A and VII-B are given. This reply implies that the tenancy entries are mentioned in village Form No. VII-A and VII-B. However, copies of the Form No. VII-A and VII-B are not supplied to the Petitioners till date.

3.

In these peculiar facts, we direct the Respondents to supply copies of the extracts of registers maintained under Form No. VII-A and VII-B to the Petitioners as per the Chart given below, within 8 weeks from the date of uploading of this Writ Petition.
