In the wake of the undertaking given by respondent and recorded by this Court as an undertaking given to it's order dated 30th April, 2024, the custody of the child is now with the petitioner.
The respondent is present before us and being a biological mother, pleads that she should be made entitled to avail video call access of the child on Wednesday and Sunday, to which the learned counsel appearing for the petitioner has no objection. 2/2 23 cp 58 of 24.doc Conferencing on Wednesday between 08:00 p.m. onwards and on Sunday between 11:00 a.m. to 12:00 noon.
Since the mother has come all the way from Udupi, Karnataka, and she is present in Mumbai, she is permitted to meet the child tomorrow i.e. 3rd July, 2024 at 04:00 p.m., and she shall be permitted to take the child alongwith her in the nearby garden or the Mall. The child shall be permitted to be in her company for the period of two hours.
As far as the permanent visiting rights are concerned, she is entitled to fle appropriate proceedings before the Court of law.
In the wake of the compliance, the contempt proceedings are dropped.
