As per the affidavit, the service cannot be said to be effected in terms of Rule 76 of the Bombay High Court (Original Side) Rules, as it is not accompanied with an acknowledgment of receipt of the notice.

In any case, there is no appearance on behalf of the respondent. Hence, issue notice to the respondent, returnable on 15/4/2024.

The Notice shall be served by registered post, prepaid for acknowledgment or by fax, speed-post or Courier with acknowledgment and also through personal service, including service via electronic mail.
