The Petitioner seeks appointment of an Arbitral Tribunal to adjudicate the disputes that have arisen between the parties, out of a partnership agreement dated 25th April 2023.

By notice dated 25th July 2023, the Petitioner has sent an email to the Respondents invoking the arbitration clause, requesting the Respondents to participate in appointment of an arbitrator. According to Petitioner, there was no reply to the email invoking the arbitration clause, although there was some correspondence between the parties earlier. In these circumstances, he seeks appointment of an arbitrator.

Issue notice to Respondents returnable within four weeks from today. The Petitioner is also permitted to serve the Respondents by private notice through all modes of communication as permissible in law. He undertakes to file an affidavit of service on or before the next date.
