Heard Mr. Panchal, learned Counsel for the Petitioner and Mr. More for the Respondent No.1.

Our attention is invited to the order passed by the Hon'ble Supreme Court in Special Leave to Appeal No.2028 of 2023 dated 6th February, 2023 which reads as under:

"

Upon our expressing reservations in entertaining this petition, particularly when the contention with reference to Rule 4(2) of the Maharashtra Civil Services (Regulation of Seniority) Rules, 1982 does not appear to have as such been urged before the High Court, learned counsel for the petitioner submits that as per his instructions, such ground had specifically been taken

With these submissions, learned counsel for the petitioner seeks permission for the petitioner to withdraw with liberty to file a review petition before the High Court and to approach this Court over again in case occasion so arises.

Permission granted.

This special leave petition is dismissed as withdrawn, with liberty as prayed."

Having heard Mr. Panchal, we see no error apparent on the face of the record in the order to warrant interference in exercise of our review jurisdiction.

The review petition is dismissed.
