PILWP 3 of 2024

1. Mr Faldessai has invited our attention to the order passed by the Authority in compliance of the order dated 8.10.2024, thereby discharging the proceedings initiated pursuant to the show cause notice dated 14.8.2024 against Mr Tarun Radhkrishnin Tahilian, who faced a complaint from one Mr Dhirendra Phadte, the petitioner in PILWP No. 3/2024, and also at the instance of the petitioners. The order dated10.1.2025 is placed by the petitioner in PILWP No. 4/2024 along with an additional affidavit. In PILWP No. 3/2024 a challenge is raised to the said order.

2. Since the issue involved in both the Public Interest Litigations is identical and on previous occupations, time was sought on behalf of the Government agency to file affidavit in reply, today Mr Faldessai, representing respondent nos. 1 to 3 seeks some time to file affidavit in reply traversing the pleadings in both the petitions. It is permissible for the respondents to file a common affidavit in both the petitions since the issue raised therein is common. Private respondents have already filed an affidavit in reply.

3. We expect the Government to file its response within a period of four weeks with liberty being conferred upon the learned counsel for the petitioners to file rejoinder within two weeks thereafter.

4. Renotify to 11.6.2025 at 2.30p.m.
