This is an application for restoration of the First Appeal, which came to be dismissed for non-filing of the paper book.

Despite direction of the Court vide order dated 07.09.2023 to the appellant to file paper book within twelve weeks, the appellant failed to file the paper book. The contention is that the matter slipped from the counsel for the appellant. The application for restoration of the appeal was filed promptly within the period of limitation. 4.

Considering the reasons mentioned in the application coupled with the undertaking by the counsel for the appellant to file the paper book within two weeks from today, the First Appeal is restored to file. 5.

The application is accordingly allowed and disposed of.
