The Second Appeal is preferred against a decree of eviction with respect to the suit property which is a shop block situated within the municipal limits of Murtizapur Municipal Council. The suit property is governed by the provisions of Maharashtra Rent Control Act, 1999. The First Appeal is also dismissed.

Second Appeal is barred in view of Section Rgd.

Order 2404sa101.25 34[3] of the Maharashtra Rent Control Act, 1999. 4.

In view of aforesaid, reserving liberty to the appellants to take recourse to the appropriate proceedings, Second Appeal is dismissed as not maintainable. No costs.
