It is the claim of the petitioner, that he was appointed as a Pro-Vice Chancellor vide order dated 16-12-2019 pursuant to the provisions of Section 10(3) and Section 13 of the Mahatma Gandhi Antarrashtriya Hindi Vishvavidhyalaya Act, 1996, for a period of 5 years. According to the learned Counsel for the petitioner, merely because the Vice-Chancellor has resigned that by itself will not render the further continuation of the petitioner illegal and as such the impugned order thereby removing the petitioner from the post of Pro-Vice Chancellor is illegal.
