DATE : 24TH JUNE, 2025 In this matter, this Court passed the order on 26/04/2024, which is reproduced as under:

"An assurance is given by the learned Additional Government Pleader that entire case of the petitioner shall be processed for releasing his pension and the compliance shall be reported to this Court by 18-6-2024. 2.

Stand over to 19-6-2024"

In pursuance of the same, the respondent No.2 filed affidavit-in-reply dated 03/01/2025 and made statements in paras-3, 4 and 5, as under:

It is submitted that, the answering respondent no.3 in respecct of the letter issued by Accountant General Nagpur on 20/06/2024 and in view of the order passed by this Hon'ble Court 26/04/2024, the pension case of the

2/3 petitioner is allowed/granted as per the letter dated 20/06/2024. Accordingly, the proposal was issued by the answering respondent regarding the pensionary benefits on dated 27/05/2024 to the Accountant General Nagpur. 4.

It is submitted that, the answering respondent had requested to the office of Treasury Nagpur to finalise the pension case of the petitioner so also the amount of GPF i.e. Rupees 17,65,871/- (Seventeen Lakhs sixty-five thousand eight hundred seventy-one) had been deposited with the respondent No.4 University on 29/04/2024. 5.

It is submitted that, the letter dated 05/06/2024 issued by the answering respondent and addressed to the Accountant General II, Nagpur thereby requesting to release the pensionary benefits including seventh pay, earned leave, amount of Gratuity and computation value has been made and all the above benefits shall be given to the petitioner through treasuyr office, Nagpur as early as possible. The above-mentioned letter dated 05/06/2024 addressed to Accountant General -II is Annexed herewith as Annexure R2-I for kind perusal of this Hon'ble Court. So also, the letter was issued by the answering respondent addressed to the District Treasury Officer, Nagpur dated 02/07/2024 thereby requesting to immediately proces the pension, pensionary benefits including seventh pay, amount of Gratuity and computation value to the petitioner.

The said letter dated 02/07/2024 is annexed herewith as Annexure R2 -II for kind perusal of this Hon'ble Court. It is submitted that, the letter dated 29/04/2024 was issued to the Manager, Bank of Maharashtra, Nagpur by the answering respondent thereby requesting to deposit amount of Rs.17,65,871/- in the Account of respondent no.4 University, Nagpur so that the amount GPF can be immediately realised to the petitioner. The said letter dated 29/04/2024 is annexed herewith as Annexure R2 -III for kind perusal of this Hon'ble Court. It is therefore most humbly submitted that, the grievance of the petitioner thus stands redressed." 3.

The learned counsel appearing for the petitioner admitted the fact that the petitioner received all the pensionary benefits.
