The order dated 13.03.2024 passed by the Collector, Buldhana, is placed on record whereby the respondent No.4 is disqualified to operate Setu Project. 3.

As far as the claim of the petitioner for allotment of Project is concerned, he was at the relevant time disqualified on the ground that the land was not owned by the petitioner. However, the petitioner claims that she has already submitted an affidavit thereby offering the land for operating Setu Project.

In view of the above, we fail to understand as to what prompted the respondent Collector to disqualify the petitioner. Perhaps, it is the failure of the Collector to appreciate the candidature of the petitioner when she claims that she was armed with an affidavit along with the application that the land was very much available.

In this background, the Additional Government Pleader as prayed, is granted time till Monday i.e. 16.12.2024 to make statement. Failing which, the Court will be constrained to pass appropriate order against the Collector, Buldhana.
