Heard the learned counsel for the rival parties. 2.

The petitioners who are teachers working with the Zilla Parishad are claiming benefit of one step promotional pay-scale as applicable vide Government Resolution dated 06.08.2022, so also additional house rent allowance and incentives maximum to Rs.1,500/- as per the order passed by this Court in Writ Petition No. 810 of 2021 decided on 21.02.2022. 3.

Mr. Walde, counsel appearing for the petitioners submits that the petitioners are already receiving house rent allowance, however one step promotional pay-scale is yet to be made applicable and the benefits thereunder are not yet released in favour of the petitioners. 4.

Ms Munshi, counsel appearing for the respondent no. 2-Zilla Parishad would invite our attention to paragraph 3 of the affidavit dated 26.03.2024 sworn by the Chief Executive Officer, Zilla Parishad, Gondia. The pleadings in the said paragraph are as under:

"3. At the outset, the answering respondents most respectfully submit that, the answering respondent no.2 vide order dated 09.02.2024 has decided that 872 teachers and non-teaching staff who are working in the Tribal and Naxalite

919-WP676-2024 c WP-665-2024.odt 2 area will be paid benefits of One Step Promotional pay scale declared to be applicable as per Government Resolution dated 06.08.2022 (Annexure No.P-2 to the petition) along with Additional House Rent allowances and incentives allowances which is 15% of their original salary and it will be minimum Rs.200/- and maximum Rs.1500/- payable to the employees by extending the benefit of order passed by this Hon'ble Court in Writ Petition No.810/2021 dated 21-02-2022 (Annexure No. P-5 to the petition) so also the arrears of the Tribal incentive allowances and additional House Rent allowances as per 6th Pay and 7th Pay Commission to all the employees working in Zilla Parishad, Gondia in view of the Government Resolution dated 06.08.2002 (Annexure No.P-2). Copy of the aforesaid order dated 09.02.2024 along with list of all employees is annexed herewith as Annexure R2-I." 5.

Ms Munshi, counsel for the Zilla Parishad submits that the decision to release the benefit of one step promotional pay-scale is already under process and same shall be released in favour of the petitioners and similarly situated employees in reasonable period.

On Court's query, she submitted that the process of release of the amount in favour of the petitioners shall be completed within a period of three months from today.

In view of aforesaid statement, we see hardly any reason to keep the present petitions pending as this Court is satisfied with the affidavit of the Chief Executive Officer, particularly the averments made in paragraph 3 referred to above and the assurance that the benefits shall be passed on to the petitioners within a period of three months from today, the writ petitions stand disposed of. No costs.
