Since this petition is required to be taken up for final disposal, learned counsel for the respondent submits that there are huge arrears of maintenance for wife and child, which are not deposited by the petitioner.

Learned counsel for the petitioner submits that he is challenging the proceedings itself on the ground that Hindu Marriage Act, 1955 is not applicable and that even the maintenance application was decided without considering the affidavit.

At this stage, learned counsel for the petitioner submits that according to him, the arrears are around Rs.70,000/-.

Learned counsel for the respondent disputes this calculation.

However, the petitioner to deposit arrears around Rs.70,000/- before the Trial Court in installments within a period of three months. Such deposit shall be subject to decision of this petition.

List the present petition for final disposal at the stage of admission itself on 08/04/2024.
