Khare, learned counsel for the petitioner. The petitioner seeks challenge to the impugned order dated 16/01/2023 issued by the respondent No.2-MIDC, Nagpur. By virtue of the aforesaid order, the respondent No.2 has cancelled the allotment of the plot in favour of the petitioner on the ground that the petitioner has not taken any effective steps for commencement and completion of factory building and production within a period of five years from the date of such allotment.

The learned counsel for the petitioner submits that even after passage of almost three years now, the plot which was allotted to the petitioner is in his possession. Also, the fact remains that the petitioner has immediately approached the respondent No.2 by raising his grievance on 25/01/2023 by submitting a detailed representation. The learned counsel submits that such representation is not yet decided by the respondent No.2.

In view of the above, we dispose of the present writ petition with the direction to respondent No.2 to decide the representation
2 1-WP-1714-24.odt dated 25/01/2023 submitted by the petitioner which at record page 83 (Annexure-VI) within a stipulated period of eight weeks from the date of receipt of the order of this Court.

The decision taken thereupon shall be communicated to the petitioner within a period of two weeks from the date of such decision. 5.
