The order impugned is dated 23/06/2023 issued by respondent No.3 putting services of the petitioner on supernumerary post. Drawing support from the order dated 01/11/2012 delivered in Writ Petition No.5306/2010 extending protection of service in favour of the petitioner, it is claimed that the respondent-Authority ought not have put services of the petitioner on supernumerary post.

In support of aforesaid, reliance is placed on the judgment dated 04/05/2021 in Writ Petition No.903/2020 (Raja Tukaram Shinde vs. The State of Maharastra, Tribal Development Dept., Mantralaya, Mumbai and anr. with connected writ petitions) delivered at Aurangabad Bench. 3.

Issue notice to the respondents, returnable on 29/04/2024. Notice to indicate that the petition shall be taken up for final disposal at admission stage.
