DATED :- 13th March, 2024 P.C.:

1. Heard Mr Motwani, learned Counsel who appears along with Mr Kakodkar in WP No. 73/2024 and with Mr Bandodkar in WP 841/2023 for Petitioners, Mr D. Pangam, learned Advocate General with Ms Maria Correia, learned Additional Government Advocate for Respondent No. 2 in WP 73/2024 and for Respondent Nos. 2 and 3 in WP No. 841/2023 and Ms Asha Desai, learned Senior Standing Counsel for Respondent Nos. 1 and 3 in WP No. 73/2024 and for Respondent Nos. 1 and 4 in WP No. 841/2023.

2. Mr Motwani refers to the order made by the Co-ordinate Bench of this Court at Bombay on 29/02/2024 in WP No. 986/2019 and connected matters instituted, inter alia, by present Petitioners.

3. Considering the issue raised, we grant Rule in both these petitions by keeping open Ms Asha Desai's objection that the Petitioners have an alternate and efficacious remedy for challenging the impugned order.

4. The outcome of the present petitions depends upon the outcome in WP No. 986/2019 and connected matters. Therefore, Mr Motwani states that the Petitioners will apply to the Hon'ble Chief Justice for the transfer of these petitions to the Principal Bench at Bombay so that even these petitions could be taken for consideration along with WP No. 986/2019 and connected matters. He states that such an application would be filed within 4 weeks from today.

6. Ms Correia and Ms Desai waive service for respondents in both these petitions.
