It is stated in the application that petitioner No. 1 expired on 01/01/2023. Copy of death certificate is annexed with application. Hence, it is necessary to bring legal heirs of petitioner No. 1 on record.

It is seen that the petitioner has expired on 01/01/2023 during the pendency of the matter and the present application is filed on 23/02/2023 i.e.

within time stipulated and right to sue survives.

Hence, the application is allowed.

Permission is granted to the applicants to bring the legal heirs of the deceased petitioner No. 1 on record. Necessary amendments be carried out in the cause title of the matter.
