CAF No. 52/2024 in First Appeal No. 213/2023 Coram : Registrar(Judicial) Dated : 06.02.2024 This application is filed by the applicant for bringing legal representatives of deceased respondent no.1-Jarnal Singh Dilip Singh Malaiya on record, who is reported to be passed away on 29.09.2023 as informed by counsel for the respondent vide Pursis St. No. 02/2023 dated 28.11.2023. The death certificate of the deceased respondent no.1 is enclosed with the said Pursis.

It is seen that respondent no.1 passed away on 29.09.2023 and the present application for bringing LR's of deceased respondent no.1 is filed on 13.12.2023 i.e.

within time and right to sue survives.

Hence, the application is allowed. Legal heirs of deceased respondent no.1 be brought on record. Necessary amendments be carried out in the cause title of the appeal memo.

First Appeal No. 213/2023 Re-issue notice to respondent no.2, returnable within six weeks.
