The present application is preferred by the Original Claimants, who are aggrieved by the quantum of compensation awarded by the learned Member, Motor Accident Claims Tribunal, Nagpur in Claim Petition No.689 of 2017. There is a delay of 306 days in filing the first appeal.

The husband of the applicant no.1 died in a road accident and the claim petition was filed by the widow, daughter and mother of the deceased.

Although the application is vehemently opposed by the learned Counsel for the respondent no.2, in my considered opinion since the appeal is arising out of a death claim and the Claimants are the widow and daughter of the deceased, one opportunity should be granted to the Claimants to ventilate their grievance in respect of the quantum of compensation awarded. Hence
