CAF No. 542/2024 in CAF No. 1975/2021 in First Appeal St. No. 11988/2021 Coram : Registrar(Judicial) Dated : 20.02.2024 This application is filed under Order 5 Rule 20 of the Code of Civil Procedure, 1908, for substituted service upon respondent nos. 2 and 3 by paper publication. It is stated that the notice issued to the aforesaid respondents could not be service through regular mode. It is stated that no other address except the present one is available with the applicant.

It is stated that the aforesaid respondents are residing on the given address, however, they are trying to avoiding the service of notices since the respondent no.4 who is residing on the same address, is already served. The applicant thus prays for substituted service upon aforesaid respondent.

Considering the reasons mentioned in the application and the bailiff report, the applicant is allowed to serve aforesaid respondents by substituted service on last known address.

Substituted service be effected upon the aforesaid respondent nos. 2 and 3 by publishing notice in widely circulated local daily newspaper i.e.

("Lokmat Samachar", Nagpur Edition), in terms of Order V Rule 20 (1-A) of CPC, returnable within four weeks from the date of publication of notice.
