This is an application for condonation of delay of 1328 days caused in filing this appeal against the judgment of Railway Tribunal.

Heard learned Advocates of both sides.

It is contended in the application that the applicant is poor and handicapped. He is facing financial crisis and due to the poverty he could not manage the money to file application for condonation of delay within a period of limitation. Further he has to go for medical treatment.

Learned Advocate for the respondent strongly objected the application and submitted that there is no

Considering the reasons stated in the application, it appears that the delay is not deliberately caused, therefore, the application deserves to be allowed in the interest of justice.

The application is allowed.

The delay of 1328 days caused in filing first appeal is condoned.
