Considering the reasons mentioned in the application and the fact that the appellant- department is a Corporation particularly when there is no malafide on the part of the appellant in causing the delay, the delay is required to be condoned. Considering the period of delay, some costs is required to be imposed.

Hence, the delay in filing the appeal is hereby condoned subject to deposit of costs of Rs.5,000/- with the District Bar Association, Gondia.

The application is disposed of accordingly.
