It is stated by the appellant that the respondent no.1 is reported to be dead and respondent no.2 is her legal heir who is already on record and right to sue survive against the said respondent no.2. Thus, the appellant prays for deletion of respondent no.1 from the array of the respondents.

Since the application is formal in nature and supported by affidavit, the same is allowed. The appellant is permitted to delete respondent no.1 from the array of the respondents, at the risk of the appellant. Necessary correction be carried out in the cause title of the appeal.
