Smt. Jijabai Prakash Ghodmare v. Narendra @ Natthu S/O Ambadas Bhusari

CAS No. 4/2025 in Second Appeal No. 81/2022 Coram : Registrar(Judicial) Dated : 09.01.2025 This application is filed by the applicants for bringing them as legal heirs of deceased sole respondent - Narendra @ Natthu Ambadas Bhusari on record. It is stated in the application that the applicants came to know about the pendency of the present proceeding after the death of the respondent on 10.11.2023 and the applicants being his legal heirs are required to be brought on record. The copy of death certificate is filed on record. The application is supported by affidavit.

It is seen that the aforesaid respondent passed away on 10.11.2023 during the pendency of the appeal and the present application is filed on 21.12.2023 i.e. within time stipulated and right to sue survives. Hence, the application is allowed.

Permission is granted to the applicant to bring the legal heirs of the aforesaid deceased respondent on record as mentioned in the application. Necessary amendments be carried out in the cause title of the appeal.
