CAS No. 226/2024 in Second Appeal No. 406/2006 Coram : Registrar(Judicial) Dated :21.03.2024 This application is filed by the applicant for bringing legal heirs of deceased appellant no.3- Pradep Manohar Shenmare on record. It is stated in the application that appellant no.3 expired on 27.08.2023 leaving behind his heir i.e. his wife. Hence it is necessary to bring LRs of deceased appellant no.3 on record as right to sue survives. The copy of death certificate is filed on record. The application is supported by affidavit.

It is seen that the appellant no.3 passed away on 27.08.2023 and the present application for bringing LR's of deceased is filed on 06.10.2023 i.e.

within time and right to sue survives.

Hence, the application is allowed. LR's of deceased appellant no.3 be brought on record. Necessary amendments be carried out in the cause title of the appeal memo.
