CAO No.75/2024 in MCA (Review) No. 596/2021 in Second Appeal No. 518/2018 (D) Coram : Registrar(Judicial) Dated : 11.01.2024 This application is filed under Order V Rule 20 of the Code of Civil Procedure, 1908, for grant of permission to serve the respondent No. 8 by substituted service i.e. by affixing a copy of notice on the door of the house in which aforesaid respondent resides. It is stated in the application that the notice issued to the aforesaid respondent returned back unserved. It is stated in the application that the aforesaid respondent is residing on the given address and the applicant is not having any other address except the present one. It is further stated that the aforesaid respondent is avoiding the service of notice. In order to make effective service of notice, the applicant thus prays for issuing notice by substituted service upon aforesaid respondent.
Considering the reasons mentioned in the application, the application is allowed. Substituted service be effected afresh on respondent no. 8 by affixing a copy of notice on some conspicuous part of last known address of the respondent in terms of Order V Rule 20(1) of C.P.C.. The notice is made returnable within four weeks.
