The second appeal was admitted on 5th February, 2010 by this Court and subsequent thereto same was listed for final hearing.

Since the counsel remained absent, the appeal was dismissed in default under Order XLI Rule 17 of the Civil Procedure Code, which has led to filing of both these applications.

Though served, none appears for the non-applicants No.5 in the matter, but learned A.G.P. appears for non-applicant Nos.1 to 4.

That being so, subject to costs of Rs.2,000/- to be deposited with the Family Court Bar Association, Nagpur, I deem it appropriate not only to condone the delay, but also to restore the appeal, as it is assured by Mr. S.T. Dhurwey that he
